Terms of Service — GeoNudge

Short version: Use GeoNudge for its intended purpose. Subscriptions are managed by Apple / Google and their refund policies apply. Geofencing relies on GPS and OS-level location services — accuracy is not guaranteed. We are not liable for missed reminders.

Acceptance of Terms

These Terms of Service ("Terms") govern your use of the GeoNudge mobile application ("App") operated by NomNom Labs ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Use of the App

GeoNudge is a location-based reminder application. You may use it for lawful personal purposes. You agree not to:

Use the App for any unlawful, harmful, or fraudulent purpose
Attempt to reverse-engineer, decompile, or extract source code from the App
Use the App to surveil or track any other person without their knowledge and consent
Interfere with the App's operation or attempt to circumvent any security measures

We reserve the right to terminate your access to the App if you violate these Terms.

Subscriptions and Purchases

GeoNudge offers optional paid tiers (Pro, Pro+) that unlock additional features. The following applies to all purchases:

Billing: Purchases are processed by Apple (App Store) or Google (Play Store) depending on your device. Payment is charged to your App Store / Google Play account at confirmation of purchase.
Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
Cancellation: You can cancel at any time through your App Store or Play Store subscription settings. Cancellation takes effect at the end of the current billing period — access continues until then.
Refunds: Refund requests are handled by Apple or Google in accordance with their respective refund policies. We have no ability to issue refunds directly.
Price changes: We may change subscription pricing. You will be notified of any price changes before they take effect, and you may cancel before the new price applies.
Restore purchases: If you have previously purchased a subscription, use the "Restore Purchases" option in Settings to re-activate it on a new device.

Location Services and Accuracy

GeoNudge relies on your device's GPS and operating system location services. You acknowledge that:

Geofencing accuracy depends on GPS signal quality, OS scheduling, and device hardware. Alerts may be delayed or not fire in areas with poor GPS coverage (e.g. indoors, underground).
iOS and Android may limit background location access to conserve battery. We cannot guarantee alerts will fire in all circumstances.
GeoNudge is a convenience tool. Do not rely on it for safety-critical reminders (e.g. medication that must not be missed, time-sensitive legal obligations).

We are not liable for any harm resulting from a missed or delayed reminder.

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices.

Intellectual Property

The App, including its design, code, graphics, and content, is owned by NomNom Labs and protected by copyright and other intellectual property laws. These Terms do not grant you any ownership rights. You are granted a limited, non-exclusive, non-transferable licence to use the App on your personal device in accordance with these Terms.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided by the App.

Limitation of Liability

To the maximum extent permitted by applicable law, NomNom Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of data or reminders
Missed alerts due to GPS inaccuracy or OS restrictions
Loss of profit or revenue
Any other loss or damage arising from your use of the App

In no event shall our total liability to you exceed the amount you paid for the App in the 12 months preceding the claim, or $10 USD if you have not made any purchases.

Changes to the App and Terms

We may update the App or these Terms at any time. When we make material changes to the Terms, we will update the date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

We may modify, suspend, or discontinue any part of the App at any time without notice or liability.

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which NomNom Labs is established, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
